General terms and conditions of purchase

These General terms and Conditions of Purchase and the Privacy Policy regulate the use of the website www.iamofficialmusiclover.com. The use by the customer of the services of the Internet shop presupposes, in any case, adherence to the General Conditions of Purchase in the version published at the time of the purchase order. It is therefore advisable for the customer to read these General Terms and Conditions before making a purchase.

Customers have the possibility to place all orders from the website www.iamofficialmusiclover.com. Each customer declares that they are fully entitled to use credit cards and that they have sufficient funds to cover all costs resulting from the purchase of products through MUSIC LOVER.

By pressing the “Pay” button during the purchase process, the member declares to fully and unreservedly accept all of these General Terms and Conditions of Sale.

The data recorded by MUSIC LOVER constitutes proof of the transactions made between MUSIC LOVER and the members of its Private Community. MUSIC LOVER will confirm your order by sending you an email.
The contractual information is presented in English/Spanish and will be confirmed at the latest at the time of delivery.

MUSIC LOVER reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of registration of the orders (subject to the availability of the product), except for obvious typographical errors.

The products remain the property of the supplier until such time as the price has been paid in full.

MUSIC LOVER reserves the right to refuse an order from any member with whom it has a dispute.

1. SCOPE OF THE CONTRACT
   These General Conditions of Purchase apply to the sale of all products on the website, to consumers to whom orders can be delivered in Europe (Euro zone only). MUSIC LOVER reserves the right to cancel the access account of a user if fraudulent, speculative or bad faith acts are detected in the use of this service.

2. PRICE
   The applicable prices are those indicated on the website on the date of the order. The prices shown on each product include V.A.T. (Value Added Tax). The amount of the shipping costs is indicated to the customer in a detailed manner at the time of placing the order.

3. PAYMENT
   Payment will be made at the end of the purchase process and will be an essential condition for the formalisation of the purchase. Under no circumstances may payment be made at a later date. Payment by means of deferred procedures such as cash on delivery or payment in shop at the time of collection of the order is not permitted.

Methods of payment accepted:
Purchases can be paid for by Visa®, Mastercard® or American Express® credit card as well as by 4B or 4B Maestro debit card. In the event that the POS (Point of Sale Terminal) informs the customer that the card has been refused, the order will be automatically cancelled and the customer will be informed on-line of this cancellation.
In the event of choosing the bank transfer payment method, the order will not be dispatched until the payment has been formalised. In any case, the choice of payment method is made during the purchase process on the corresponding screen. The suppliers or issuers of payment methods may adopt anti-fraud measures that lead to the rejection of certain types of transactions. MUSIC LOVER is not responsible for the application of such security policies.

Paypal (not yet available). In this mode the payment will be charged according to the customer has contracted with paypal in the same way the returns where the company has to pay any amount will be made by the same way.this mode has a cost for the customer of 3.4% + 0.35 € on the value of the purchase and the amount of the order.

4. DELIVERY AND SHIPPING COSTS
   The supplier will send the products to the distribution warehouse, from where the products will be shipped to the final destination at the address set by the buyer. The buyer will receive an e-mail when the order has been collected by the carrier.

Deliveries are prepared every working day. Once we receive your order we will prepare it and send it as soon as possible.

Transport costs will be borne by the buyer.

The purchase order corresponding to the order will be available on MUSIC LOVER, once the payment has been confirmed, which can be viewed via the link: “My Orders”, as soon as the e-mail has been sent. This original purchase order includes delivery costs and VAT.

MUSIC LOVER will ask its customers to choose the place of delivery, specifying their home, office or centre where they want the product to be delivered. The delivery time can be consulted in “Delivery Times”.
MUSIC LOVER will inform the customer of the departure of the order from the distribution warehouse, by sending an email.

Each delivery is considered to have been made as soon as the product is made available to the customer by the carrier, as evidenced by the control system used by the carrier. It is up to the recipient to check the order at the time of delivery and then make any reservations and complaints that appear justified, including the possibility of refusing the package if it has been opened or if it has obvious signs of deterioration.

Orders will be delivered to the address indicated by the customer.

The address indicated by the customer may be a home address, a place of work or any other address indicated. It is not necessary that the billing address and the delivery address match.

RETURN

All products sold may be returned within 14 calendar days from the date of delivery, in accordance with the provisions of the Spanish Retail Trade Act. Previously, the customer must indicate their intention by email. MUSIC LOVER will reply by means of another email specifying the precise instructions for returning the product.

The return costs will be borne by the customer.

The refund of the amount paid for the returned garments will be made by means of a purchase voucher for the said amount with no expiry date. The purchaser will be able to consult this code in his MUSIC LOVER Store account. This voucher will be available to the customer within 7 days of receipt of the goods by MUSIC LOVER.

Under no circumstances may the goods supplied be returned if they have clearly been used.
The products must be returned correctly protected, in their original packaging, in perfect condition (not damaged or soiled by the customer) with all accessories, instructions and documentation. They will be sent to the place specified by MUSIC LOVER in the precise instructions for the return of the product sent by email.

In the event that the return is not accepted by the supplier on the grounds that the product to be returned has been used, these products will remain in the distribution warehouse to be collected by the customer for a period not exceeding thirty days from their return.

Packages which do not contain any enclosed element allowing the sender to be identified (order number, name, address, etc.) may not be returned.

The costs and risks associated with the return of the product shall be borne by the sender, who must send them safely and with the necessary guarantees to ensure that the returned goods arrive in perfect condition.

Anyone returning a product will receive an email informing them of the amount of their refund.

SECURITY

For your security MUSIC LOVER has entrusted the credit card payment system to a payment gateway.
The bank details entered are encrypted and securely transmitted to the bank’s servers and then verified with the issuing bank to prevent fraud and abuse.

This data entry procedure is guaranteed by 128-bit SSL (Secure Socket Layer) encryption technology, one of the most advanced and effective protection systems currently available, thanks to which no third party will have access via the Internet to the information relating to the bank details entered by the customer.

Only the Bank and PayPal have access to bank details linked to these means of payment, so that MUSIC LOVER does not know or record these data during the payment transaction.

5. GUARANTEE OF THE PRODUCTS PURCHASED
   The contractual guarantee offered is the one established in the Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users. MUSIC LOVER will be liable for any lack of conformity that becomes apparent within two years of delivery.

6. APPLICABLE LAW AND JURISDICTION
   These General Conditions of Purchase are subject to Spanish law. The parties submit, at their choice, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of Palma, Illes Balears.

LIABILITY, LITIGATION AND APPLICABLE LAW

MUSIC LOVER cannot be held liable for non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, total or partial disruption or strike, in particular of postal services and means of transport and/or communications, flood or fire. In the event of a dispute, the member shall give priority to MUSIC LOVER in order to obtain an amicable solution.
